Welcome to Swadishh! These Terms of Service ("Terms") govern your access to and use of our recipe platform, website, mobile application, and services (collectively, the "Service"). By accessing or using Swadishh, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Swadishh, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Swadishh on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

Eligibility

You must be at least 13 years old to use Swadishh. By using the Service, you represent and warrant that you meet this age requirement.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up-to-date

3. User Content and Conduct

Your Content

You retain ownership of recipes and content you create on Swadishh. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Display, distribute, and perform your content on the Service
  • Modify and adapt your content for technical purposes
  • Use your content to improve our AI features and services

Prohibited Content

You agree not to post content that:

  • Is illegal, harmful, or violates any laws
  • Infringes on intellectual property rights of others
  • Contains hate speech, harassment, or discriminatory content
  • Is spam, misleading, or fraudulent
  • Contains viruses or malicious code
  • Violates privacy rights of others

Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms. We may suspend or terminate accounts that repeatedly violate our policies.

4. Subscription Plans and Payments

Free Plan

Our free plan includes 5 recipes per month. This plan is subject to change, and we reserve the right to modify features and limits.

Pro Plan

The Pro plan costs ₹149/month and includes:

  • 150 recipes per month
  • Priority support
  • Advanced AI features

Payment Terms

  • Payments are processed securely through Razorpay
  • Subscriptions automatically renew monthly unless cancelled
  • You can cancel your subscription at any time
  • Refunds are handled on a case-by-case basis
  • Price changes will be communicated 30 days in advance

5. Intellectual Property

Our Property

The Service, including its design, features, AI technology, logos, and trademarks, are owned by Swadishh and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

Your Property

You retain all rights to your original recipes and content. However, by using our AI features, you acknowledge that AI-generated content may be similar to other AI-generated content.

6. Service Availability

We strive to provide reliable service but cannot guarantee:

  • Uninterrupted or error-free service
  • That all features will always be available
  • That the Service will meet all your requirements

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

7. Disclaimers

Recipe Accuracy

Recipes on Swadishh are provided "as is" for informational purposes. We do not guarantee the accuracy, safety, or suitability of recipes. Always use your judgment and follow proper food safety practices.

Nutrition Information

Nutrition estimates are AI-generated approximations and should not be used as medical advice. Consult a healthcare professional for dietary needs.

Allergies and Dietary Restrictions

Always check ingredients carefully if you have allergies or dietary restrictions. We are not responsible for allergic reactions or health issues resulting from recipe consumption.

8. Limitation of Liability

To the maximum extent permitted by law, Swadishh and its operators shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Issues arising from use of recipes or content
  • Service interruptions or technical failures

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

By You

You may terminate your account at any time by contacting support@swadishh.com or using account deletion features (when available).

By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your published content may remain visible unless you request deletion. We may delete your account and data after a reasonable period.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
